Confidentiality and Non-Compete

Users of our Site hereby understand that the videos, tools, models, frameworks, processes, strategies, materials and information presented on our Sites are copyrighted and proprietary.

User agrees not to record, duplicate, distribute, teach or train from our information in any manner whatsoever without our express written permission. Any unauthorized use or distribution of our Sites proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and Promoter will pursue legal action and full damages if these terms are violated in order to protect its rights.

Your Participation

By participating in our zoom calls, videos or other recorded meetings,submitting questions, email or posting any material you grant (or warrant that the owner of such rights has expressly granted) us, anyone authorized by us, and/or relevant affiliated companies the perpetual, worldwide, irrevocable, royalty-free, non-exclusive, unrestricted right to use, copy, modify, transmit, sell, exploit, create derivative works from, distribute, and/or publicly perform or display your questions, comments and postings, in their original or edited form, in whole or in part, in television programs, books, articles, commentaries, in any manner or medium, now known or later developed, for any purpose.

We retain the right to modify or remove material that we, in our sole discretion, consider infringing or otherwise unacceptable. We also reserve the right to edit materials for any other reason.

Whether or not we modify or remove such material, users remain solely responsible for the content of their messages. You warrant that any “moral rights” in posted materials have been waived. You are not entitled to any compensation for any materials you may post on the Sites.

Refund Policy

Current refund policies are as follows, and may change from time-to-time. 

Video Library: We offer a 30-day refund. In the event that you decide your purchase was not the right decision, within 30 days of purchase of the library, contact our support team at help@thenewgame.com and let us know you’d like a refund. Refunds will be for the total price paid for the library only, not including any other coaching, consulting, masterminds, labs or other services, less $250 for administrative costs. We will NOT provide refunds more than 30 days following the date of purchase. After day 30, all payments are non-refundable and you are responsible for full payment of the fees regardless if you use the library. 

Coaching, Consulting, Masterminds, Labs, Services: There are no refunds for any of these due to the nature of these services. 

Please note: If you opted for a payment plan and have not refunded according to the refund policy within 30 days, you are required to complete the remaining payments of your payment plan. If you are on a payment plan and fail to make further payments, your access will be removed without refund of previous payments.

All refunds outside of this policy are discretionary as determined by Mitchell Axelrod and/or his designated associates. Mitchell Axelrod and/or his designated associates reserves the right to issue refunds for extenuating circumstances, as we deem necessary. All refunds will be for the total price paid for the library only, less administrative and materials costs.

Ability To Accept Terms And Conditions

You affirm that you are either more than 18 years of age, or an emancipated minor, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms and Conditions, and to abide by and comply with these Terms and Conditions. 

Miscellaneous

These terms will be governed by and construed in accordance with the laws of the State of California, without regard to any principles of conflicts of law. You agree that any action at law or in equity that arises out of or relates to these terms will be subject to mediation in the State of California. If any of these terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions. These terms may be modified only by our posting of changes to these terms of use on our Sites.
